Effective date: 2026-09-05 Operated by: Sigma Scheduling LLC, a limited liability company registered in the State of Utah, USA ("Sigma Scheduling," "we," "us," "our") Contact: hello@sigmascheduling.com Address: 1303 N High Cliffs Cir, Washington, UT 84780, USA Website: https://sigmascheduling.com
By creating an account or using Sigma Scheduling, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.
These Terms govern your use of the Sigma Scheduling app as Staff. An Employer's use of the Service, including by its administrators, is governed by the Employer's separate agreement with us.
Sigma Scheduling is a group dispatch and time-tracking platform that Employers use to schedule staff, dispatch them to jobs, and record work hours. Features include shift scheduling, geofenced clock-in/out, timesheets and corrections, manager approvals, and SMS/push notifications.
The Service is provided to Employers on a paid subscription basis. Unless your Employer tells you otherwise, use of the app by Staff is free to you — subscription fees are a matter between the Employer and us. Employer billing terms (amounts, renewal, and payment) are set out in the Employer's separate agreement or order with us. Card payments are processed by a third-party payment processor; we do not store full card numbers.
You agree not to: misuse or attempt to gain unauthorized access to the Service; interfere with its operation, integrity, or security; falsify time, location, or identity data; scrape, reverse-engineer, or copy the Service except as permitted by law; or use the Service unlawfully, to harass others, or on behalf of someone else without authorization.
When you clock in or out, the Service captures and stores your device's GPS location at that moment so your Employer can review where the punch took place relative to the assigned work site. Location never blocks or prevents you from clocking in. You control location access through your device permissions; denying it does not stop you clocking in, but your Employer may see that the punch had no location attached. How we handle this data is described in our Privacy Policy.
Sigma Scheduling provides tools to Employers; it does not employ you, is not your employer or joint employer, and is not a party to your employment relationship. Decisions about your schedule, pay, hours, approvals, discipline, and employment are made by your Employer, not by us. Questions or disputes about your work, hours, or pay should be directed to your Employer. We are not responsible for your Employer's acts, omissions, or use of the data in the Service.
We are continually improving the Service and may add, change, suspend, or discontinue features at any time. We will try to avoid material disruption, but we are not liable for changes to or discontinuation of any feature.
The Service relies on third parties (for example, cloud hosting, notification delivery, mapping, and payment processing) and may link to or interoperate with third-party services. We do not control and are not responsible for third-party services, and your use of them may be governed by their own terms and privacy policies.
The Service, its software, design, and content are owned by Sigma Scheduling LLC and its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service except as permitted by law. "Sigma Scheduling" and our logos are our marks; you may not use them without permission.
If you send us feedback, ideas, or suggestions about the Service, you grant us a perpetual, worldwide, royalty-free license to use them for any purpose without obligation or compensation to you.
You obtain the app through a third-party app marketplace ("App Provider," such as the Apple App Store or Google Play), and your use is also subject to that App Provider's terms. You agree that:
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that notifications will always be delivered or delivered on time, or that stored data will always be accurate. Do not rely solely on notifications for time-critical obligations; check the app.
To the maximum extent permitted by law, Sigma Scheduling LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, wages, revenue, data, or goodwill, arising out of or relating to the Service, even if advised of the possibility. Our total aggregate liability for any claim will not exceed the greater of (a) the amounts you paid us (if any) in the twelve months before the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Sigma Scheduling LLC from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of applicable law or the rights of a third party.
We may suspend or terminate your access if you violate these Terms, or to protect the Service or others. Your Employer may also remove your access. You may stop using the Service at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive. Certain records may be retained as described in the Privacy Policy.
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at hello@sigmascheduling.com and attempt to resolve the dispute informally for at least 30 days. If it cannot be resolved, you agree to the exclusive jurisdiction of the state and federal courts located in Utah, except where prohibited by law.
We may update these Terms. We will change the "Effective date" above and, for material changes, provide more prominent notice. Continued use of the Service after changes take effect means you accept the updated Terms.
